A partnership is a contractual body of a few partners with unlimited liability and no separate legal entity; a company is a registered body corporate with limited liability, many members and perpetual succession.

Differences between partnership and company:

  • Governing law & formation: partnership under the Indian Partnership Act 1932, formed by agreement; company under the Companies Act, formed by registration.
