The Medical Termination of Pregnancy Act was enacted in India in 1971 to provide safe, legal access to abortion under specific circumstances. The law does not permit abortion on demand; instead, it lays down clear conditions under which a pregnancy may be terminated. These safeguards exist for two fundamental reasons that balance individual rights with broader social and medical concerns.

The first reason is to protect the physical and mental health of the woman. Pregnancy termination is a medical procedure that carries risks, and the law ensures it is performed only when continuing the pregnancy would pose a greater threat to the woman's well-being than ending it. The conditions require that a registered medical practitioner certify that continuing the pregnancy would involve risk to the life of the pregnant woman, or cause grave injury to her physical or mental health. This includes situations where the pregnancy results from contraceptive failure in a married woman, or where there is substantial risk that the child, if born, would suffer from serious physical or mental abnormalities.
