Instead, the law itself imposes an obligation on a person, resembling a contractual duty, to prevent them from being unjustly enriched at another person's expense.
Examples:
- A person who finds goods belonging to another and takes them into custody is subject to the same responsibility as a bailee — the finder must take reasonable care of the goods and is bound to return them to the true owner, and may not simply keep them.
- If necessaries are supplied to a person incapable of contracting (e.g. a minor, or a person of unsound mind), or to someone whom the incapable person is legally bound to support, the supplier is entitled to be reimbursed a reasonable price from the incapable person's property, even though no valid contract was ever formed with them. …
