Under the Indian Contract Act, a contract can be performed by the promisor himself, by his agent, by his legal representatives after his death, or by a third person accepted by the promisee — depending on whether personal skill is required.

The Indian Contract Act lays down who must perform a contract:

  1. Promisor himself — where the contract involves the personal skill, taste or qualification of the promisor (such as painting a picture or singing at a concert), it must be performed by the promisor personally.
  2. Agent of the promisor — where personal skill is not essential, the promisor may perform the contract through a competent agent.
  3. Legal representatives — on the death of the promisor, his legal representatives (heirs) are bound to perform contracts not involving personal skill; their liability is, however, limited to the value of the property inherited. Contracts of a personal nature come to an end on death. …
