A complaint is disallowed if it is outside the Act's conditions — wrong complainant, commercial purpose, time-barred, frivolous, or outside the forum's jurisdiction.

The redressal agency can refuse to admit or can dismiss a complaint in situations such as:

  • Not a consumer: the person does not fall within the definition of 'consumer' (e.g. obtained the goods free, or is not the buyer/user with consent).
  • Commercial/resale purpose: the goods or services were obtained for resale or for a commercial purpose (except where used to earn a livelihood by self-employment).
  • Time-barred: the complaint is filed after the limitation period (generally two years from the cause of action) without sufficient reason for the delay.
  • Frivolous or vexatious: the complaint is false, frivolous or made with malicious intent; the forum may dismiss it and even impose costs. …
