If the partnership deed is silent, interest on a partner's loan to the firm is paid at 6% p.a. — a statutory default, not a matter of choice.

The Indian Partnership Act, 1932 lays down a set of default rules that apply whenever a partnership deed does not expressly provide for a matter. For a loan advanced by a partner to the firm (as distinct from partner's capital), Section 13(d) of the Act provides that the partner is entitled to interest on such a loan at the rate of 6% per annum, counted from the date the loan is advanced, regardless of whether the firm has earned a profit or incurred a loss in that year — this interest is a charge against profits, not an appropriation, so it is payable even if the firm makes a loss.
