Under the Consumer Protection Act, 2019, a consumer is any person who buys goods or hires services for a consideration, but does not include a person who buys for resale or commercial purposes.

The Consumer Protection Act, 2019 (CPA) is the law that safeguards the interests of consumers in India. Before we define who a consumer is, it helps to understand why this definition matters. The entire framework of consumer rights — the right to safety, to be informed, to choose, to seek redressal — hinges on who qualifies as a consumer. If you are not a consumer under the Act, you cannot file a complaint before a consumer commission.

The CPA defines a consumer in two broad categories: one for goods and one for services.

For goods, a consumer is any person who buys any goods for a consideration that has been paid or promised, or partly paid and partly promised, or under any system of deferred payment. The key point here is the word consideration — it means you have paid money (or will pay) for the goods. A gift or a free sample does not make you a consumer.

For services, a consumer is any person who hires or avails of any service for a consideration. This covers everything from a haircut to a telecom connection to a doctor’s consultation. Again, the service must be paid for, or promised to be paid for.

Note

The Act also includes any user of such goods or services, if the use is made with the approval of the buyer or hirer. For example, if your mother buys a mixer and you use it, you are also a consumer under the Act — provided your mother (the buyer) approved your use.

Now, there is an important exclusion. The definition does not include a person who obtains goods for resale or for any commercial purpose. This is a critical distinction. If you buy a dozen mobile phones to sell them in your shop, you are not a consumer — you are a trader. Similarly, if you buy a machine to run a business, you are not a consumer under the Act. …
