Consumer Duties and Responsibilities

Rights alone cannot protect a consumer who does not act carefully. Consumer-protection law expects every buyer to exercise certain duties, so that the rights described above actually work in practice. These duties are not enforced by punishment in the way rights are enforceable through consumer forums; they are responsibilities a sensible consumer is expected to follow for their own protection and for the health of the market as a whole.

Key consumer duties/responsibilities:

  • Be a cautious and alert buyer. Do not buy the first product offered; compare quality, price, and terms before deciding.
  • Check quality and certification marks. Look for a recognised standard mark on the product (see the next section) before purchase, especially for items that affect health and safety.
  • Insist on a cash memo or bill. A bill is the primary proof of purchase and is essential for any complaint, replacement, or warranty claim.
  • Read labels and instructions carefully. Check the manufacturing date, expiry date, price (MRP), net quantity, and usage instructions before use.
  • File only genuine complaints. The right to be heard and the right to seek redressal should be used honestly, not to make false or exaggerated claims against a seller.
  • Be aware of one's own rights. A consumer who does not know the six rights cannot exercise them; awareness itself is a responsibility.
  • Exercise the right to choose wisely. Compare available alternatives rather than buying out of impulse or peer pressure.
