Under the Consumer Protection Act, 2019, a consumer who has suffered loss or injury can seek replacement of the defective product or compensation for the harm caused.

The Consumer Protection Act, 2019 (CPA) was enacted to provide swift and effective redressal to consumers when goods or services fall short of promised standards. The law recognises that a consumer is the weaker party in a marketplace transaction, so it arms them with specific remedies. When a complaint is upheld by a consumer forum — be it the District Commission, State Commission, or National Commission — the forum can order one or more of the reliefs listed in Section 39 of the Act.

Two of the most commonly granted reliefs are:

1. Replacement of the defective product.

If a purchased good is found to be defective — for instance, a mobile phone that does not charge, a mixer that stops working after a week, or a garment that tears on first wash — the consumer can ask for a new, fault-free item in its place. The forum may direct the seller or manufacturer to replace the product with a similar one of the same brand and model, free of any additional cost to the consumer. This remedy restores the consumer to the position they would have been in had the product been defect-free from the start.

Note

Replacement is typically ordered only when the defect is substantial and cannot be repaired. For minor defects, the forum may instead order a free repair (rectification of the defect).
