Liability of joint promisors:
- Section 42 requires all the joint promisors, during their lifetime, and their representatives after death, to jointly fulfil the promise, unless a contrary intention appears in the contract.
- Section 43 provides that, in the absence of an express agreement to the contrary, the promisee may compel any one or more of the joint promisors to perform the whole of the promise — the promisee is not required to sue all of them together.
- The joint promisor who is made to perform the whole promise is then entitled to claim equal contribution from the other joint promisors. …
