Both views have genuine merit — a citizen's rights don't vanish on leaving office, but the whole point of protecting the CEC's tenure was to guarantee impartiality, which a foreseeable post-retirement political career could quietly compromise.

The case for allowing it. A retired CEC is, after leaving office, an ordinary citizen again, and the Constitution guarantees every citizen the right to join a party and contest elections without restriction by income, education, class, or gender. Denying this right specifically to former Election Commissioners would be an unusual, targeted restriction on an otherwise universal right.

The case against it. The Constitution goes out of its way to protect the CEC's independence while in office — a fixed term, a salary that cannot be reduced, and removal only via a special-majority recommendation of both Houses of Parliament, precisely so a ruling party cannot pressure or remove a CEC for refusing to favour it. But that protection is worth much less if a sitting CEC can reasonably expect a political career, and the backing of a specific party, once their term ends. Even without any actual wrongdoing, the possibility of that expectation shaping decisions taken while still in office is exactly the kind of risk the whole design of an independent Election Commission exists to prevent — because public trust in the EC's neutrality is itself part of what keeps Indian elections credible. …
