Under the Consumer Protection Act, 2019, a complaint may be filed by several categories of person: the consumer themselves; any recognised consumer association, whether or not the consumer is a member; the Central Government, the Central Authority (CCPA), or a State Government; one or more consumers, with the Commission's permission, on behalf of numerous consumers with the same interest; or, if the consumer has died, their legal heir or representative. A complaint must generally be filed within two years from the date the cause of action arose, though a Commission may condone a delay for sufficient cause.

A significant, deliberately consumer-friendly change from the 1986 Act is where a complaint may be filed. The 1986 Act generally required filing where the opposite party (the seller) resided or carried on business. The 2019 Act instead allows filing in the Commission having jurisdiction over the place where the complainant (the consumer) resides or personally works, which is a major convenience for online purchases where the seller could be located anywhere in the country. The Act also permits e-filing, so a complaint can be lodged without necessarily visiting a Commission's office in person.

The 2019 Act further introduces mediation as an alternative route: where a Commission believes an early settlement is possible and both parties agree, the dispute can be referred to a Consumer Mediation Cell attached to that Commission; a successful mediated settlement carries the same binding effect as a Commission's own order, offering a faster and less adversarial resolution. …
