Q.What is the Consumer Protection Act, 2019, and why did India need to replace the 1986 Act with it?
The Consumer Protection Act, 2019 is the current central law governing consumer rights and consumer-dispute redressal in India. It came into force on 20 July 2020 and completely repealed and replaced the earlier Consumer Protection Act, 1986.
The 1986 Act had served consumers for over three decades, but the marketplace it was designed for had changed dramatically by the time it was replaced. Retail had shifted heavily toward e-commerce, teleshopping, direct selling, and multi-level marketing — forms of trade the 1986 Act never contemplated and had no real power to regulate. Misleading advertisements, sometimes carrying celebrity endorsements, had become widespread, and there was no dedicated authority empowered to act quickly and on its own initiative against such practices, even where they harmed a whole class of consumers rather than one complainant. The redressal forums under the old law were also seen as slow and inconvenient for an ordinary buyer to approach, since a complaint generally had to be filed where the seller was located.
To close these gaps, the 2019 Act introduced several new features: the Central Consumer Protection Authority (CCPA) to act against unfair trade practices and misleading advertisements even without an individual complaint; mediation as a faster alternative dispute-resolution route; a new product-liability regime letting an injured consumer claim compensation directly from a manufacturer or seller; and a simplified filing process, including e-filing and filing at the consumer's own place of residence. Together, these changes were designed to bring consumer law up to date with a modern, increasingly digital marketplace.
