Even legitimately created authority needs to be limited, because power without limits can produce unjust laws — and a constitution that gave citizens no power at all would defeat its own purpose of commanding lasting acceptance.

A constitution must place limitations on rulers because settling who has the authority to make decisions is not, by itself, enough to guarantee a just society. Even a government that came to power through a perfectly legitimate procedure could go on to pass laws that are obviously unjust — banning a religion, permitting arbitrary arrest, restricting basic liberties based on someone's group identity. This is exactly why constitutions name fundamental rights — protection from arbitrary arrest, freedoms of speech, conscience, association and trade — that the government they create can never be allowed to violate, even though these rights may be reasonably curtailed under the specific emergency conditions the constitution itself lays down. …
