The Constitution shows a unitary bias through provisions such as Parliament's power to alter or even end a State's existence and the far-reaching emergency provisions, and while a strong Centre does not make States powerless in every respect, several of these very provisions do translate into real constraints on State autonomy.

Two clear reasons can be given for the claim that the Indian Constitution has a unitary bias. First, the very existence of a State, including its territorial integrity, is in the hands of Parliament — Parliament is empowered to form a new State by separating territory from an existing State or by uniting two or more States, and it can also alter the boundary or even the name of any State (with only a State legislature's view being sought as a safeguard, not its consent). Second, the Constitution contains very powerful emergency provisions that can turn India's federal polity into a highly centralised system: during an emergency, power becomes lawfully centralised, and Parliament can make laws even on matters normally within the States' jurisdiction. Other features that reinforce this bias include the Centre's dominant financial powers (major revenue sources under central control, with States dependent on central grants), the Governor's power to reserve State bills for the President's assent and to recommend dismissal of a State government, Parliament's ability (with Rajya Sabha's ratification) to legislate on State-List subjects, the constitutional superiority of the Union's executive power over the States', and the all-India services, whose officers serve the States but remain under central government control for discipline and removal. …
