A petition under Article 32 on behalf of India's urban homeless would argue that denying ration

To the Supreme Court of India, under Article 32 of the Constitution:

The petitioners represent India's urban homeless population -- roughly three million people, fewer

than five per cent of whom have access to a night shelter. Because ration cards and voter

identification require proof of a fixed residential address, homeless citizens are systematically

excluded from both the Public Distribution System and the electoral roll, despite being citizens

entitled to the same rights as any other.

This denial violates Article 14 and Article 15 (equal treatment and non-discrimination, since housed

and homeless citizens are treated unequally in access to a basic welfare entitlement and to political

participation, for a reason -- homelessness -- that has nothing to do with their eligibility as

citizens) and Article 21 (the right to life with dignity, which the Supreme Court has already held to

include the right to food and an adequate standard of living, and which is undermined when a

citizen's most basic welfare access depends on having an address they, by definition, do not have).

The petitioners respectfully request the Court to direct the relevant government departments to: (1)

delink eligibility for ration cards and voter registration from proof of a fixed residential address;
